By signing up for our delivery service, you agree to be bound by these Terms and Conditions, including for Flor De Lima Farms to send you emails and texts about your “Delivery Service” account and promotional ads. Employee and Customer Conduct

Flor De Lima Farms and our Delivery Service depends on lasting relationships with our customers. This is a mutual responsibility of both Flor De Lima Farms employees and our customers. Both parties are to conduct themselves is a professional and respectful manner. There will be zero tolerance for the mistreatment both verbally of physically towards our employees. Flor De Lima Farms and its employees have the right to refuse service to any customer that violates these Terms and Conditions. All actions taken by Flor De Lima Farms are at its sole discretion.

Limitation of Liability.

Flor De Lima Farms and their respective officers, directors, employees, and agents (the “Released Parties”) make no warranty, express or implied, including, but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to the Juice Delivery Service. By participating in the service, you hereby release to the fullest extent that law permits, the Released Parties from and against any and all claims, damages, losses, liabilities, and other expenses (including, without limitation, attorney’s fees) relating to your participation in the Delivery Service.

Arbitration Agreement.

You and we(Flor De Lima Farms) agree that, any dispute, claim or controversy arising out of or relating in any way to our services, including, without limitation our Delivery Service, your account(s), our online store, promotional offers, user interfaces, our Privacy Policy or our privacy practices generally, these Terms and Conditions, and this Arbitration Agreement, shall be determined by binding arbitration. Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. YOU AGREE THAT, BY AGREEING TO THESE TERMS, THE U.S. FEDERAL ARBITRATION ACT GOVERNS THE INTERPRETATION AND ENFORCEMENT OF THIS PROVISION, AND THAT YOU AND WE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. This arbitration provision shall survive termination of these Terms of Use and the termination of your account(s).

Miscellaneous.

Without notice to you, Flor De Lima Farms reserves the right to suspend any Delivery Service account(s) and/or terminate any account(s) and/or your participation in the Delivery Service if Flor De Lima Farms determines, in its sole discretion, that you have violated these Terms and Conditions or that your use is unauthorized, deceptive, fraudulent or otherwise unlawful.

Acknowledgement.

These Terms and Conditions, including all documents referenced herein, represent the entire understanding between you and Flor De Lima Farms with respect to the Delivery Service, and supersede any other agreements, statements, or representations with respect to the Delivery Service. Headings used in these Terms and Conditions are for reference only, and shall not affect the meaning of any terms. Any participant of the Flor De Lima Farms Delivery Service is deemed to have accepted these Terms and Conditions and the Flor De Lima Farms Privacy Policy. Flor De Lima Farms reserves the right to change or cancel this service at any time in its sole discretion. Except as expressly provided herein to the contrary, any changes or modifications will be effective immediately upon posting the revisions to www.farmersmarketjuice.com and you waive any right you may have to receive specific notice of such changes or modifications. Your continued participation in Flor De Lima Farms Delivery Service following any such changes confirms your acceptance of these Terms and Conditions and such changes.
